Conservation Commission to Take Up Kohl’s Wetlands Delineation on August 23

Northampton’s Conservation Commission plans to discuss Kohl Construction’s wetlands delineation on August 23, 5:30pm at City Hall. Concerned citizens are urged to attend this hearing. Kohl Construction is doing business as Northern Avenue Homes and Tofino Associates. Here are the details:

Request for Determination of Applicability filed by Northern Avenue Homes, Inc. and Tofino Associates, Inc to determine whether the area depicted on the plans is an area subject to the Wetlands Protection Act and/or the Northampton Wetlands Ordinance and whether the boundaries of the resource areas depicted on the plans are accurately delineated. Project location is Northern Avenue, Map ID 25C-12 and 25C-17.
Here is Kohl’s wetlands delineation for the forest between North Street and the bike trail:



Kohl asserts that there are no existing or potential vernal pools on the development site. We would like an independent assessment to be made of the site with regards to vernal pools and the boundary of the wetlands. Some of the condo units appear to encroach within 35 feet of the wetland boundary as drawn by Kohl. An accurate delineation is critical to make sure that the actual encroachment is not even closer.
